LAWMAKER PROPOSES CRIMINALIZING AI-GENERATED NONCONSENSUAL SEXUAL CONTENT

Bagong Henerasyon Party-list Rep. Robert Nazal filed a landmark bill in the House of Representatives that aims to criminalize the use of artificial intelligence in generating nonconsensual sexual content.

Rep. Nazal introduced House Bill 807, or the “Take It Down Act of 2025,” which targets the growing misuse of AI tools in creating fake nude images and deepfake pornography used for harassment, extortion, or humiliation.


The solon emphasized the alarming rise in tech-fueled sexual abuse, citing a sharp increase in voyeurism and deepfake sextortion cases recorded by Philippine law enforcement agencies.


Under the bill, offenders who create, distribute, or even possess AI-generated explicit content without consent could face up to 12 years in prison—or 20 years if the victim is a minor and it also allows victims to file cases even if the perpetrators are based overseas.


The bill mandates the Department of Information and Communications Technology DICT to launch a “Take It Down Portal” for verified content removal requests. Once filed, takedown requests must be acted upon within 24 hours, while flagged content must be removed within 48 hours—or platforms could be fined up to one million pesos per incident.


Former BH Representative Bernadette Herrera called the bill a “long-overdue safeguard,” saying it shifts the burden of action from victims to abusers and negligent platforms.


Inspired by global initiatives like the U.S.-based “Take It Down” system and the UK’s StopNCII project, Nazal said the Philippines must fight back against digital abuse with smarter, stronger, and faster laws.
